The Federal Tax Service began "urgently" to demand from the Russians data on their cryptocurrency - "RBC-Crypto"
The Federal Tax Service of the Russian Federation began to request data on asset ownership and transactions from cryptocurrency owners. This was reported to RBC-Crypto in the company for control, accounting and analytics of the CFA BitOK.
The Federal Tax Service began sending letters to those who previously indicated that they had cryptocurrencies in their tax returns. According to the publication, they are asked "urgently" to provide all the data on their assets.
“Letters are sent to individuals who made transactions with cryptocurrencies during 2022 and 2021 and filed 3-NDFL declarations. According to the information confirming the requests, which the editors have read, they are asked to present the documents as a matter of urgency,” RBC-Crypto said.
BitOK adds that tax representatives “call and ask for information” about various transactions: most often, these relate to declarations with violations or “lack of documents confirming income and expenses” . The publication notes that in order to declare the CFA, it is necessary to provide the service with an agreement with the exchange, the name of the cryptocurrency, the date it was received and the address of the wallet. Also, owners are forced to report the “market value” of the property at the time of receipt “in rubles and dollars” and “source of income” .
“At present, the Federal Tax Service has not yet formulated a unified position regarding the taxation of digital currencies, however, if there is profit from this type of activity in rubles, the payment of tax in the form of 3-NDFL is still mandatory,” said an anonymous source in the Federal Tax Service.
The founder of BitOK, Dmitry Machikhin, says that Rosfinmonitoring, together with Russian banks, “helps the Federal Tax Service in identifying facts of evasion from filing reports” and a 3-personal income tax declaration. This even applies to "users of p2p exchange services" .
Recently, experts in the field noted that, at the moment, the tax authorities do not have information about cryptocurrency wallets opened by Russian companies and individuals. Lawyers said that the Federal Tax Service "does not understand the subject too well" , which is why "often filing a tax return raises more questions than its absence" .
However, the order of the Federal Tax Service of Russia No. ED-7-11/903 dated October 15, 2021 specifically mentions operations with cryptocurrency and digital financial assets. According to economists, the tax authorities do not have enough data on the owners of the cryptocurrency, but they have access to reporting on "fiat" transfers, because of which the authorities " may raise questions" .
Earlier, the head of the State Duma Committee on the financial market, Anatoly Aksakov, announced the parliament’s plans to completely ban cryptocurrency and introduce punishment for its use. At the same time, the Central Bank of the Russian Federation and the Ministry of Finance supported the idea of carrying out international settlements using the CFA .
